POSITION DESCRIPTION

Position Description: Assistant City Attorney/Prosecutor

Department: Legal

Position Grade: 24-25

Annual Salary Range: $84,958.81 - $141,358.75 - Contingent on experience

FLSA Status: Exempt

POSITION SUMMARY

Under the direction of the City Attorney, performs responsible and complex legal casework in the Office of the City Attorney. Prepares and conducts criminal/civil prosecutions of violations of applicable State and City laws. Expected to apply professional judgment in providing legal advice and support, and in the preparation and presentation of cases. Requires complex problem solving and skillful legal strategy.

ESSENTIAL RESPONSIBILITIES AND DUTIES

  1. Prepares and conducts criminal/civil prosecutions as assigned

1.1 Screens possible criminal prosecutions from police/public; interviews appropriate individuals

1.2 Examines and evaluates available evidence

1.3 Prosecutes criminal cases, including appeals to District Court, and the drafting of legal materials such as complaints, information, probable cause statements, arrest and search warrants, and subpoenas

1.4 Responds to appeals

1.5 Handles collection matters

1.6 Appears in court for motions, changes of plea, and sentencing

1.7 Reviews probation performance of defendants after conviction

  1. May also be required to participate in the representation of the City at administrative proceedings

2.1 Represents the City and supervises the representation of City in regard to appeals taken to the City's Administrative Law Judge ("ALJ")

2.2 Represents the City and supervises the representation of City in regard to administrative enforcement actions heard by the City's ALJ

2.3 Represents the City at the district and appellate courts in regard to appeals from orders of the City's ALJ

  1. Performs other functions within the Office of the City Attorney as may be assigned

MINIMUM QUALIFICATIONS

EDUCATION, EXPERIENCE AND CERTIFICATIONS

Graduation from an accredited law school with a Juris Doctor degree in law and a licensed member in good standing of the Utah State Bar Association.

NECESSARY KNOWLEDGE, SKILLS AND ABILITIES

  1. Knowledge of federal, state, and municipal law, with an emphasis on municipal law; knowledge of city departments and their legal needs.
  2. Skill in writing with clarity and precision.
  3. Ability to communicate effectively and persuasively, both verbally and in writing.

Due to the nature of this position, the applicant must successfully pass an initial criminal background check, subsequent checks and continuously meet the requirements of the Bureau of Criminal Identification.
