Job Description and Duties

Under the general direction of the Assistant Chief Counsel, the attorney in this position will work closely with Authority executives, senior staff (planners, engineers, and environmental specialists), and represent the Authority before external stakeholders on all phases of the development and implementation of high-speed rail project sections in Northern California, the Central Valley, and Southern California. The attorney performs the most complex work such as reviewing and advising on the development of California Environmental Quality Act (CEQA) and the National Environmental Policy Act (NEPA) documents, advising in the areas of land use, permitting (federal and state Endangered Species Acts, and 401/404/408 permits), and planning (environmental justice, Americans with Disabilities Act [ADA], and Limited English Proficiency [LEP]). This position may also work closely with private outside litigation counsel and the Attorney General’s Office.

Working Conditions

Part-time telework is available for this position for California residents based on the requirements of the position. Hiring interviews may be available virtually, using teleconferencing or video conferencing options.

Must be able to work appropriately and effectively under stress, manage more complex and varied workload and meet deadlines. Employee must be able to focus for long periods of time, multi-task, adapt to changes in priorities and complete tasks or projects with short notice. Employee must develop and maintain cooperative working relationships and display professionalism and respect for others in all contact opportunities.

While working on-site, employee will work in a climate-controlled office under artificial light. However, due to periodic problems with the heating and air conditioning, the building temperature may fluctuate. Incumbent will be required to use a computer, mouse, and video display terminal and will be required to sit for long periods of time at a computer screen. Employees may be required to travel outside of their workstation to perform general tasks.

Desirable Qualifications

In addition to evaluating each candidate's relative ability, as demonstrated by quality and breadth of experience, the following factors will provide the basis for competitively evaluating each candidate:


• Strong written and oral communication skills.

• Ability to conduct legal research and writing, sometimes under short deadlines.

• Experience with CEQA, NEPA, or associated environmental laws and how they apply to state agencies and public projects.

• Experience with CEQA or NEPA litigation.

• Experience with any one of the following: National Historic Preservation Act (NHPA), state and federal agency environmental justice guidance, regulations, and orders, the Archaeological Resources Protection Act, the Clean Air Act, the Clean Water Act, CERLCA, RCRA, Endangered Species Act, Section 4(f) of the US Department of Transportation Act, federal or state Administrative Procedures Acts.

• Experience drafting legal documents such as legislation, regulations, or contracts.

• Ability to exercise a high degree of initiative, flexibility, judgment, and confidentiality.

• Ability to operate independently, but with the judgment to know when to ask for assistance and guidance from a supervisor or colleague.

• Ability to represent the Authority in dealings with other government agencies and private entities in a way that reflects well on the Authority.

• Dependable, punctual, excellent attendance.

• Knowledge of the Authority organization, operations, and relevant policy issues.

• Experience preparing correspondence involving inclusion of recommendations for effective courses of action.

• Exercise good judgment and calm professionalism in all situations.

• Experience presenting opinions, ideas, or advice in front of numerous individuals.

• Experience balancing priorities from numerous clients regarding an array of subjects.

• Experience with environmental permitting and mitigation.
