The Florida Commission on Offender Review, formerly known as the Florida Parole Commission, is looking to fill an Assistant General Counsel position in its Office of the General Counsel. The position is located in the Commission’s Tallahassee Central Office. The incumbent in this position may represent the Commission in various types of challenges filed against the Commission, including appellate and extraordinary writ litigation related to certain post-prison supervision programs and executive clemency. This position requires knowledge of Florida statutes, administrative rules, and rules of state and federal court.

 

The Commission functions as a quasi-judicial decision-making body, responsible for the careful selection of candidates appropriate for release from incarceration to parole, and administers parole, conditional release supervision, conditional medical release supervision, control release supervision, and addiction recovery release supervision. The Commission acts as the administrative and investigative arm of the Governor and Cabinet, who sit collectively as the Board of Executive Clemency.

 

This position is classified as a full-time Selected Exempt Service position and works under the supervision of the General Counsel. The starting salary is $62,124.65.

 

Position Description

The incumbent will assist the General Counsel in reviewing executive clemency issues and providing legal assistance related to executive clemency to the Commission and the Office of Executive Clemency. The incumbent may represent the Commission in state circuit courts and district courts of appeal, the Florida Supreme Court, and federal courts.

 

The incumbent is responsible for analyzing complex litigation and legal precedent, preparing pleadings, legal memoranda, briefs, responses, orders, opinions, and various other motions in defense of the Commission and in support of the Commission and the Office of Executive Clemency.

 

As to litigation, the incumbent is responsible for appellate litigation, from the initial pleading stage through final appellate order, with minimal direction from a higher level attorney. Experience in both civil and criminal matters is desired. The incumbent must be able to exercise considerable independent judgment in analyzing a case or issue and in formulating a response. The incumbent must possess strong writing skills, excellent communication and critical thinking skills, and the ability to work independently.

 

The incumbent is responsible for providing legal advice and guidance to the Commission Chairman and Commissioners, Commission staff, and the Coordinator and staff of the Office of Executive Clemency.

 

Examples of Work

Provide legal assistance to the Commission and the Office of Executive Clemency;

Prepare written legal opinions;

Research and analyze legal pleadings and precedent;

Prepare responses, opinions, motions, orders, and various other pleadings as required;

Review and analyze proposed legislation;

Review and draft amendments to administrative rules;

Review Commission procedure directives for compliance with relevant legal authority;

Assist support staff in the processing of public records requests and requests for executive clemency records and information;

Monitor litigation assigned to outside counsel, providing legal opinions and direction; and

Other duties as assigned.

 

Required Qualifications

Admission to the Florida Bar, with membership in good standing.

 

Preferred Qualifications

Criminal justice experience preferred. Admission to the Northern, Middle, and Southern Districts of Florida is preferred. Admission to the Eleventh Circuit and the United States Supreme Court is preferred. Experience with the Administrative Procedures Act is preferred. Extraordinary writ experience is preferred. Appellate experience is preferred. Public records experience is preferred. Assistant State Attorneys and Assistant Public Defenders are encouraged to apply.
