Job Description and Duties

The California Energy Commission seeks two Senior Energy Efficiency Regulation Attorneys to help implement legislation moving the state towards its 100% renewable and clean energy future.

Under the general direction of an Assistant Chief Counsel and the general direction of the Chief Counsel, Senior Energy Efficiency Regulation Attorneys will craft written legal advice on emerging energy, environmental, and administrative law issues, and will present this advice to the Commission, its staff, and to other state and federal agencies, often in public forums.

Among other things, Senior Energy Efficiency Regulation Attorneys may advise the Commission and its staff on rulemakings and provide legal support to implement Commission regulations and programs in the following areas:

• The Commission’s innovative and globally significant energy efficiency regulations for appliances and buildings;
• The Commission’s programs to decarbonize buildings fairly and equitably throughout the state;
• The Commission’s implementation of the latest technologies to match flexible electrical demands with abundant clean and renewable energy supply;
• Proposed state and federal legislation addressing California’s clean energy future;
• federal actions that may affect California’s efforts to implement and enforce its clean and renewable energy programs;
• Certain Commission renewable energy programs;
• Participation in US Department of Energy rulemakings; and
• Other legal questions impacting the Commission’s programs.

Senior Energy Efficiency Regulation Attorneys may also provide legal advice and support on a wide variety of Commission-related legislative analyses and assist with the Chief Counsel’s law clerk program.

Senior Energy Efficiency Regulation Attorneys will join the Regulatory & Advisory Unit of the Chief Counsel’s Office. The Chief Counsel’s Office is a full-service law office involved in all phases of Commission activity, and all its attorneys have an opportunity to work directly and closely with the state’s principal energy policymakers. The Regulatory and Advisory Unit attorneys are the Chief Counsel’s experts in energy efficiency renewable energy, rulemaking proceedings, and proposed legislation, among other topics and duties.

Working Conditions

The CEC supports a hybrid workplace model with office-based and remote-centered workers. Limited in-person attendance and occasional travel may be required based on the needs of the division. Typically, attorneys are required to attend in person the CEC’s once-a-month public business meetings for items they have worked on and are supporting. Regular and consistent attendance is essential to successful performance. This position is remote-centered, which means the incumbent works 50 percent or more of their time from an alternate work location.

Desirable Qualifications

In addition to evaluating each candidate's relative ability, as demonstrated by quality and breadth of experience, the following factors will provide the basis for competitively evaluating each candidate:

The successful applicant should have strong research, analytic, and writing skills and have knowledge and experience, or demonstrated interest, in at least three of the following:
(1) State or federal environmental or energy law, including but not limited to the California Environmental Quality Act and the Warren Alquist Act;
(2) California laws governing regulatory agencies with legislative and regulatory powers and duties, including but not limited to the Administrative Procedure Act;
(3) federal agency rulemaking procedures; and
(4) litigation and/or litigation support. All applicants must be a member of the State Bar of California.
