Job description
The Court of Protection solicitor will be responsible for providing legal advice and representation to clients involved in matters related to mental capacity and decision-making. The solicitor will handle cases within the Court of Protection, advocating for individuals who lack capacity and require assistance in their personal and financial affairs.
Key Responsibilities:
Client Representation:
- Represent clients in the Court of Protection in matters related to health, welfare, and financial decisions.
- Provide legal advice and guidance to clients and their families regarding mental capacity issues.
Case Management:
- Manage a caseload of Court of Protection cases, ensuring all aspects of the legal process are handled effectively.
- Draft legal documents, including applications, witness statements, and court submissions.
Legal Research and Compliance:
- Stay abreast of changes in legislation and case law related to mental capacity and Court of Protection matters.
- Ensure compliance with legal and ethical standards in all aspects of client representation.
Client Communication:
- Communicate effectively with clients, keeping them informed about the progress of their case and explaining legal matters in a clear and understandable manner.
Collaboration:
- Work closely with other legal professionals, healthcare professionals, and relevant authorities to ensure comprehensive support for clients.
- Collaborate with the legal team to share knowledge and expertise in Court of Protection matters.
Advocacy:
- Attend court hearings and represent clients effectively in the Court of Protection.
- Advocate for the best interests of clients who lack mental capacity.
- Role can be based in Manchester, London, Basingstoke, Liverpool.
Requirements
- Qualified solicitor with a valid practicing certificate.
- Experience in Court of Protection work, with a strong understanding of mental capacity issues.
- Excellent communication and interpersonal skills.
- Strong analytical and research skills.
- Ability to work independently and as part of a team.
- High level of professionalism and ethical standards.
- NQ - Grade A Solicitor
