Job description

The Court of Protection solicitor will be responsible for providing legal advice and representation to clients involved in matters related to mental capacity and decision-making. The solicitor will handle cases within the Court of Protection, advocating for individuals who lack capacity and require assistance in their personal and financial affairs.

Key Responsibilities:

  1. Client Representation:

    • Represent clients in the Court of Protection in matters related to health, welfare, and financial decisions.
    • Provide legal advice and guidance to clients and their families regarding mental capacity issues.
  2. Case Management:

    • Manage a caseload of Court of Protection cases, ensuring all aspects of the legal process are handled effectively.
    • Draft legal documents, including applications, witness statements, and court submissions.
  3. Legal Research and Compliance:

    • Stay abreast of changes in legislation and case law related to mental capacity and Court of Protection matters.
    • Ensure compliance with legal and ethical standards in all aspects of client representation.
  4. Client Communication:

    • Communicate effectively with clients, keeping them informed about the progress of their case and explaining legal matters in a clear and understandable manner.
  5. Collaboration:

    • Work closely with other legal professionals, healthcare professionals, and relevant authorities to ensure comprehensive support for clients.
    • Collaborate with the legal team to share knowledge and expertise in Court of Protection matters.
  6. Advocacy:

    • Attend court hearings and represent clients effectively in the Court of Protection.
    • Advocate for the best interests of clients who lack mental capacity.
  7. Role can be based in Manchester, London, Basingstoke, Liverpool.
