POSITION SUMMARY

In conjunction with Strategic Business Units (SBUs) and Functional Center of Excellence (FCEs) (as our business partners), the Contract Manager plays a crucial role in drafting and managing all processes and phases of the sourcing life-cycle including RFPs, RFQs, and RFIs, leading to drafting, negotiating and administering commercial contracts of varying degrees of complexity for acquisition of goods and services of all types in the supplier channel.

This role will conduct contract negotiations involving substantial financial commitments with terms and conditions according to a well-defined process with existing SMEs as support while establishing an advantageous framework. The Contract Manager will function within corporate policy and best practices, facilitate corporate compliance tasks regarding Accessibility, FCPA, GDPR, Information Security, PIA, etc. in the pre-contracting workflows and maintain current knowledge of market conditions and trends, and assist in formulating short and long-term procurement strategies to ensure economy, quality, and continuity of supply.

PRIMARY RESPONSIBILITIES

· Analyzes business needs based upon appropriateness, compliance with corporate policies and goals, quantity, specifications, and delivery requirements. · Ensures compliance with and adherence to local, and government regulations/statutes and to ETS policies and procedures to protect ETS's financial, legal, and business interests. · Determines priorities for multiple projects and liaise with management for such items needing escalation. · Act as ETS Subsidiary’s representative and trusted advisor to business partners on all phases of the Source to Settle process. · Selects and approves potential suppliers in conjunction with internal customers and policies. · Manage vendor relationships and contract lifecycle management for both new sourcing needs and renewals while acting as the internal supplier channel expert. · Ensures optimum use of ETS funds through development and use of sourcing techniques such as RFPs, RFIs, and RFQs. Receives and analyzes replies to bid requests; negotiates and writes contracts, and awards business. · Reviews and analyzes supplier-prepared documents, i.e., contracts, leases, licenses, specifications, statements of work, and other such documents; proposes and negotiates changes; drafts amendments, modifications, and addenda; and alerts responsible parties to potential problems, liabilities, or unusual terms. · Reviews all transactions in their earliest stages to ensure compliance with ETS accessibility requirements, FCPA, GDPR, information protection security, personal identifiable information (PIA), and credit card usage security (PCI), as applicable. · Maintains continual focus on achieving cost reductions/savings/avoidances consistent with annual corporate and department objectives. · Collaborate with stakeholders to develop the appropriate purchase order resulting from a negotiated contract. · Maintain contracts in the enterprise software while maintaining clean and current records in the software. · Ensure contracts are signed using the e-signature method and the proper signatory authority is used on the commercial contracts. · Member of the global category team that may interact with other sourcing departments in ETS for market or segment expertise. · Manage assigned ad-hoc projects as needed and/or required. · Adhere to ethical standards and comply with the laws and regulations applicable to the stakeholders.

KNOWLEDGE/SKILLS : · Contract risk mitigation (legal, financial, business, and security) · Possess strong analytical and problem-solving skills to meet cost savings/reduction goals. · Familiarity with bid process management/compliance · Quality contract drafting skills, for RFPs, Statement of Work (SOW’s), Letter of Agreement (LOAs). · Understanding of contract lifecycle performance management. · Proficiency in the following software – MS Office (Excel, Word, and PowerPoint), Agiloft, DocuSign, Adobe Professional, and MS SharePoint, OneNote · Demonstrate superior oral and written communication skills, contract law knowledge, contract content and structure knowledge, negotiation skills, and work organization skills. · Demonstrate business acumen with strong interpersonal and communication skills suitable to interact with all levels of management, internal clients, suppliers, and coworkers, promoting accuracy, efficiency, objectivity, fairness, and courtesy. · High degree of independent judgment, attention to detail, and project management skills.

EDUCATION AND EXPERIENCE: · A bachelor’s degree in a business-related field or commensurate appropriate business experience in lieu of a bachelor’s degree. · MBA preferred. · Proven experience as a Contract Manager or in a similar role. · Trade or industry association membership optional 4-6 years of progressively responsible category management plus contract writing, negotiating, and managing experience within a procurement or supplier contract management organization
