Job description

1. Legal Advisory

· Provide strategic legal counsel to the company's leadership team.

· Stay updated on changes in land laws, land revenue act, RERA, and other relevant legislation.

· Interpret and apply legal principles to guide decision-making.

2. Document Drafting and Review

· Draft, review, and negotiate agreements for property sales, conveyance deeds, declarations, and other legal documents.

· Ensure that all legal documents are in compliance with applicable laws.

3. Property Due Diligence

· Conduct title search reports on land and properties.

· Assess the legal status of properties and recommend actions to resolve any issues.

4. Society Formation and Redevelopment

· Handle the legal aspects of society formation and redevelopment projects.

· Ensure compliance with government regulations and agreements with societies.

5. Government Liaison

· Establish and maintain relationships with various government departments and authorities.

· Keep updated on government circulars, notifications, and regulatory changes affecting the real estate industry.

6. Court Cases and Legal Disputes

· Manage and oversee all legal disputes related to real estate.

· Monitor various court judgments related to real estate issues and provide guidance accordingly.

7. Compliance and Risk Management

· Monitor the company's compliance with relevant laws and regulations.

· Identify and mitigate legal risks associated with real estate operations.

8. Team Leadership

· Lead and manage the legal team, providing guidance, mentorship, and professional development opportunities.

· Foster a culture of compliance and legal excellence within the team.

9. Risk Assessment and Mitigation

· Conduct comprehensive risk assessments for real estate projects.

· Identify potential legal, financial, and operational risks.

· Develop and implement strategies to mitigate identified risks.

· Advise senior management on potential risks and recommend risk-reduction measures.

10. Title Investigation and Due Diligence

· Oversee title searches and due diligence activities.

· Verify property ownership, encumbrances, and legal compliance.

· Analyze land and revenue records, family trees, and historical disputes.

· Provide recommendations based on due diligence findings.

11. Contract Drafting and Review

· Prepare, review, and negotiate various agreements and contracts.

· Ensure contracts are legally sound, protect the company's interests, and align with project objectives.

· Maintain a repository of standardized contract templates for common transactions.

12. Negotiation and Communication

· Engage in negotiations with landowners, contractors, government authorities, and stakeholders.

· Secure favorable terms and resolve disputes through effective communication.

· Maintain communication channels with external legal counsel.

13. Compliance Management

· Stay updated on changes in real estate laws and regulations.

· Develop and implement compliance programs to ensure legal requirements are met.

· Train and educate internal teams on legal and compliance matters.

14. Policy Development

· Develop and implement internal legal policies and procedures.

· Ensure policies align with industry standards and regulatory requirements.

15. Strategic Planning

· Contribute to the development of the company's business and strategic plans.

· Offer legal insights and guidance to align with the company's objectives.

17. Team Leadership

· Recruit, train, and manage a team of legal professionals.

· Provide guidance and mentorship to team members for professional development.

18. Financial Oversight

· Review and approve budgets related to legal department expenses

· Monitor and control legal expenditures to ensure cost-effective operations.

19. Reporting and Documentation

· Prepare regular reports for senior management and board members.

· Summarize legal department activities, risks, and accomplishments.

· Maintain organized and comprehensive documentation of all legal matters and agreements.

20. Ethical and Professional Conduct

· Uphold high ethical standards in all legal activities and transactions.

· Ensure compliance with the company's code of conduct and professional ethics.

Competencies

Knowledge of Real Estate Workflow, SOPs, Real estate laws, Construction laws, Contract laws, and Regulatory compliance.

Qualifications  Bachelor's degree in Law (LL.B) from a reputable institution. A Master's degree or additional certifications in real estate law is a plus.

Experience  Minimum of 18 years of legal experience with a focus on real estate law, including transactional and regulatory matters.

Technical Skills  MS Office, G Suite, Microsoft 365, Online portals for Legal matters, ERP.
