About the Role:
The selected individual will join the Legal and Compliance Team for India and will collaborate closely with various business and functional units within India. The primary responsibility entails furnishing guidance, counsel, and assistance on matters related to law, litigation, contracts, and compliance, all aimed at ensuring adherence to legal and regulatory standards. This position necessitates active cooperation with internal departments such as Sales, Marketing, Operations, Human Resources, and Finance, along with external legal experts, to manage legal disputes and litigation. The chosen candidate will offer essential legal insights, which encompass the analysis of medical device regulations as well as other relevant laws pertaining to the organization. Additionally, the candidate will aid in research and communication, and proactively track and convey new developments.
Responsibilities & Requirements:
- Offer guidance and counsel to business divisions regarding legal requirements and pruocedural inquiries.
- Support and act as a single point of contact in Legal department for Contract Management Process.
- Deliverday-to-day support in advising the stakeholders related to legal and contractual matters concerning but not limited to supply contracts, consignment contracts, confidentiality agreements, Service Agreements, Capital Equipment Management Program, Volume Based Rebate Agreements, Product Supply Agreements, channel partner contracts.
- Offer guidance and assistance concerning all legal HR matters, including employee disputes, contract drafting, legal and compliance communications, policy making and training initiatives.
- Engage with the global Third-Party team to on-board, review TPIs, audit and monitoring of TPIs, training on the policy requirement to employees and TPIs.
- Engage in direct interaction with the local and global teams for managing Channel Partners, entailing tasks such as onboarding, conducting due diligence, carrying out reviews, overseeing audits, monitoring activities, providing training, and facilitating communication.
- Independently manage cases related to dispute resolution, settlements, and litigations involving third parties, collaborating with external legal experts for resolution.
- To work closely with the Global Compliance team and business units for handling audits, Channel partner reviews, developing action plans and their implementation.
- Work proactively and collaboratively with peers in India shared service team and APAC regional teams, compliance, HR and/or relevant business teams to provide guidance, advice and support in the region.
- Work closely with APAC on developing Centre of Excellence programs.
- Assist the regional and global team on business integrations/M&A activities for India Hubb.
- Collaborate with subject matter experts and stakeholders for adherence to pertinent laws and regulations, encompassing emerging medical device regulations, medical device laws, the General Data Protection Regulation, India Data Protection Laws, trade compliances, HR laws and more and advising management accordingly.
- Keep abreast of legal and compliance developments and managing issues across the India hub, encompassing countries like Bangladesh, Nepal, and Sri Lanka, and offer timely advice on updated laws, regulations, and industry codes.
- Oversee the guidance, mentoring, and development of legal and compliance interns.
- Assist the General Counsel with the projects as they arise.
- Hold a Law degree with 8-10 years of relevant experience in the discipline, with an added preference of Corporate Secretarial skills.
