YOUR MISSION
Within the business unit dedicated to the sales of products & services for the floating solar markets in Europe, Middle East & Africa (EMEA), you will be responsible for contract and legal management, and you will act as a referent to protect the interests of the company when selling floating solar products and associated services (engineering, construction, maintenance...). You will be reporting directly to the Managing Director of the EMEA business unit and indirectly to the company deputy director in charge of contractual & legal matters.
CONTRACT MANAGEMENT
- Upon request from the EMEA team dedicated to the sales of products & services for the floating solar market, you will act as CONTRACT & LEGAL MANAGER to discuss, draft and approve fair agreements while mastering the associated risks for C&T:
- Products/Services Sales Contracts
- General Terms & Conditions of Sale, Warranty Conditions
- EPC Contracts for floating PV projects implementation, O&M Contracts
- Cooperation Agreements with partners (agent or specific collaboration)
- Supply Chain Contracts (molds purchase, products manufacturing, parts supply,…)
- NDAs, Master of Understanding, Letter of exclusivity, Term sheet
- You will be responsible for developing and maintaining templates of contracts with standards terms, defined to limit company"s liability exposure
- You will ensure that each agreement implemented complies with those standards terms. For out-of-standard cases, you will work closely with the team to negotiate and reach a fair contract, which shall be accurate, complete and consistent with the project
- You will assist the team in the contractual aspects of the projects, in order to clarify the obligations and limits of responsibility of the parties and raise awareness and ownership of contractual aspects within the team, particularly for sales and project managers
- You will participate upon request to key negotiation and commercial meetings (travels). If necessary, you will make a summary of the key points to assist in decision making
- You will ensure the contract's administration (proper records & reporting)
LEGAL MANAGEMENT & ADMINISTRATIVE SUPPORT
- You will secure the legal aspects of any contract related to the sales of products & services (compliance to the applicable laws and regulations)
ü You will provide administrative support for audit / due diligence process for qualification of C&T as supplier or subcontractor for floating solar projects in EMEA markets.
- You will assist for insurance matters related to the products & services, such as insurance policies for specific projects (10year guarantee, all-risk construction...) or potential claims, and for any disputes with third parties (clients, suppliers, ...)
YOUR PROFILE
You have a degree in law or contract management or possibly in business or engineering but with a solid theoretical and practical background in the field of international or European contracts related to products supply and/or facilities construction.
You have at least 5-10 years" experience in a similar position
- You are familiar with international contracts and have already worked on large industrial projects, ideally in the energy sector, within a company operating as EPC contractor in a multicultural environment (international teams & projects).*
