IP Staff Attorney - Electronic Frontier Foundation (EFF)

The Role: Staff Attorneys advancedigital rights by means of integrated legal advocacy, including developing andprosecuting substantive lawsuits, filing amicus briefs, counseling clients,enforcing public records requests, lobbying legislators, communicating with thegeneral public, helping develop EFF policy, and supporting the work of EFF’sactivists and technologists.
For this position, we are looking for candidates withexperience litigating copyright issues. Experience with or a strong interest inpatent law, artificial intelligence, unfair competition, and administrative, ortrade secret litigation is preferred but not required.
The idealcandidate will have at least 3 years of litigation experience, though somequalified candidates may have more. That experience should include devising andcarrying out case strategy and handling day-to-day projects and deadlines.
Responsibilities:
Managing all aspects of litigation, including:
- Case and issueidentification; factual development and investigation; legal research andwriting; client identification and communications; co-counsel identificationand communications where needed; and formulation of legal strategy
- Litigating in federaland state courts, including meeting and management of deadlines; researchingand drafting pleadings; client relationship management and communication; coordinating and communicating withattorneys outside EFF (opposing counsel, co-counsel, parties’ counsel, etc.);identifying and coordinating with outside experts and amici curiae; and courtappearances and oral argument
- Coordinating withother teams at EFF concerning interests implicated by litigation andformulating press strategy
- Submitting amicusbriefs in non-EFF litigation
Developing and communicating EFF policy positions,including :
- Identifying andarticulating policy positions on emerging tech issues
- Coordinating andparticipating in discussions across teams and subject-matter experts at EFF,including through participation in the EFF working group process, on thedevelopment of policy
- Factual and legalresearch and writing
- Collaborating withother stakeholders (NGOs, companies, academics) and subject-matter expertsoutside EFF on the development of, and advocacy for, EFF policy
- Communicating policypositions to government through testimony, formal comments, or other direct orindirect communications (e.g., administrative/regulatory rulemakings, lobbying)
Counseling clients on non- or pre-litigation matters:
- Conducting intake ofpotential clients
- Identifying legalissues, conducting legal research, and assessing legal risk for clients
- Communicating risks toclients and counseling about legal options and alternatives for avoiding risks
- Maintainingcommunication and relationships with clients, which includes addressingquestions and concerns
- Communicating withadverse parties (e.g., responding to demand letters)
Communicating EFF positions to the public, including :
- Providing spoken andwritten commentary to the press about EFF issues
- Speaking about EFFissues at conferences, schools, or other public events
- Writing about EFFissues for the public, including in blog posts, editorials, etc.
- Maintaining dialoguesand relationships with stakeholders (other NGOs, companies, governmentofficials or employees, academics, private attorneys) working on issuesrelevant to digital rights
Organizational, administrative, and other support,including :
- Attending andcontributing to team meetings
- Providing summary ofwork, on a quarterly basis, for board book
- Providing feedback,input, advice, or legal review to other members of the legal team or otherteams at EFF
- Coordinating internsand/or supervising their work
- Travel
- Tracking time forreporting lobbying hours and obtaining fees in litigation
Requirements:
- Law degree
- California Bar admission (which may occur afterbeing hired by EFF)
- At least three years litigation experience.
- Experience andenjoyment exploring and advocating on digital rights issues
- Strong time managementskills
- High level oforganization, attention to detail, and follow-through
- Ability to workindependently
- Excellent research,analysis, written and verbal communication skills
- Excellent judgment,especially when dealing with complex policy issues and unexpected questions
- Must demonstrate careand respect toward coworkers, outside partners, members of the public, donors,and others with whom this role interacts
- Must work topositively and collaboratively resolve conflicts and overcome challenges
- Must be able tounderstand and articulate with accuracy EFF’s mission, positions, and work
- Must be available andresponsive to colleagues, outside partners,and others over email, phone, and online chat, with the ability to respond andreliably to time-sensitive requests for assistance and opportunities during agreed-upon work hours

- Classification Status: Exempt, union, full-time
- Compensation: $135,000-$150,000 DOE
- Expected hours of work: Typically, Monday - Friday
- Reports to: Director, AI and Access to Knowledge, SeniorStaff Attorney
- Supervisory responsibilities: None formally, but may supervise interns on specificprojects.
- Physical Demands: This position requires the ability to lift upto 5 lbs. on occasion.
- Travel: EFF hosts twoone-week all-staff gatherings at our San Francisco offices each year in thespring and fall, and all staff are expected to attend. There will also beopportunities to attend relevant professional conferences remotely or inperson.
- Location: This position is based at EFF’s offices inSan Francisco with the ability to work from home several days per week asdetermined in collaboration with the Legal Director.
